Gallagher, a firm supporter of [[Donald Trump]], was reported to have attended the Stop the Steal Rally due to boredom. It is also mentioned by reports that he was an avid watcher of Fox News. Gallagher participated in the riots, wanting to overturn the election results. Despite his firm belief that the 2020 presidential election was rigged, when violence started to escalate, he was reported to have tried to stop another rioter from assaulting an officer with a chair. He was later arrested for participating in the riots. Although he was one of hundreds to participate in the storming of the capitol, prosecutors have viewed Gallagher as one of the less violent rioters on January 6, typically claiming that his crimes are "in many ways substantially less severe". Despite this, because Gallagher still participated in a seditious event, he is still given some sanctions for doing so, as he was punished 4 months probation, $500 restitution, and 60 hours of community service. He faced up to six months prison, but due to lower-severity of his crimes, avoided jail time altogether. Gallagher has ultimately expressed remorse for his involvement in the riots, claiming he expressed "immense shame and anxiety" for the choice he made that day.
